Planit Protein Terms of Service

1. Introduction

Welcome to Planit Protein! These Terms of Service ("Terms") govern your use of our website, products, and services. By accessing or using our website (www.planitprotein.com) or purchasing our products, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

2. Who We Are

Planit Protein ("Company," "we," "us," or "our") is a provider of plant-based protein solutions, including proprietary starter cultures, fermentation ingredients, and dry blends designed for use with the Planit POD fermentation system. The Planit POD appliance is exclusively manufactured and sold by Waring Commercial, an independent third party. Planit Protein does not manufacture, sell, ship, or warrant the Planit POD hardware. When you purchase a Planit POD, you are entering into a transaction directly with Waring Commercial and are subject to their terms of service and warranty policies.

3. Eligibility & User Responsibilities

By using our website, you confirm that you:

  • Are at least 18 years old or have permission from a legal guardian.
  • Will provide accurate, complete, and up-to-date information when making purchases or creating an account.
  • Will not misuse our website, attempt to breach security, or use it for unlawful activities.

4. Orders & Payment

  • All purchases are subject to availability. We reserve the right to refuse or cancel orders at our discretion.
  • Prices are subject to change without notice.
  • We accept payments through secure third-party payment providers. By completing a purchase, you authorize us to charge the provided payment method.
  • Taxes, shipping, and handling fees may apply and will be clearly disclosed at checkout.

5. Shipping & Returns

  • Shipping: We process and ship orders as quickly as possible. Estimated delivery times are provided but may vary due to carrier delays or other external factors outside our control. Planit Protein is not responsible for delays caused by third-party carriers.
  • Returns: Due to the perishable and food-safe nature of our products, returns are only accepted for unused, unopened items within 14 days of delivery. To initiate a return, contact john@planitprotein.com.
  • Wrong or Missing Items: If you receive an incorrect or incomplete order, notify us within 7 days of delivery and we will arrange a replacement or correction at no additional cost.
  • Damaged or Defective Products: If you receive a damaged or defective consumable product, notify us within 7 days of receipt for a replacement or refund.
  • Refund Processing: Approved refunds will be processed to your original payment method within 5–10 business days.
  • POD Hardware Returns: The Planit POD appliance is sold by Waring Commercial. All hardware returns, exchanges, and warranty claims must be handled directly with Waring Commercial per their return policy.

6. Intellectual Property & Content

  • All content on our website—including text, images, branding, product descriptions, and technology—is owned by or licensed to Planit Protein.
  • You may not copy, distribute, or reproduce any content without our explicit written permission.

7. Use of the Planit POD System

Planit Protein's consumable products (starter cultures, legumes, and dry blends) are formulated specifically for use with the Planit POD fermentation appliance manufactured by Waring Commercial. Please note the following:

  • Planit Protein does not manufacture, distribute, sell, or service the Planit POD appliance. All hardware purchases, warranty claims, repairs, and appliance-related support must be directed to Waring Commercial.
  • Our consumable products are intended for use in commercial foodservice and professional kitchen environments. While individual enthusiasts may use our products, they are formulated and tested for commercial-scale fermentation.
  • Misuse, unauthorized modification, or use of non-approved products with the Planit POD appliance may void Waring's warranty and may limit Planit Protein's liability with respect to fermentation outcomes.
  • Planit Protein is not responsible for any injury, property damage, or loss arising from malfunction, misuse, or failure of the Planit POD appliance.

8. Warranty Disclaimer

PLANIT PROTEIN'S CONSUMABLE PRODUCTS ARE PROVIDED "AS IS" FOR USE IN FERMENTATION PROCESSES. TO THE FULLEST EXTENT PERMITTED BY LAW, PLANIT PROTEIN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

PLANIT PROTEIN MAKES NO WARRANTY REGARDING THE PLANIT POD APPLIANCE, WHICH IS MANUFACTURED AND WARRANTED SOLELY BY WARING COMMERCIAL. ANY HARDWARE WARRANTY CLAIMS MUST BE DIRECTED TO WARING COMMERCIAL IN ACCORDANCE WITH THEIR WARRANTY TERMS.

Fermentation outcomes depend on many variables including preparation technique, ingredient quality, environmental conditions, and proper use of the Planit POD. Planit Protein does not guarantee specific fermentation results.

9. Limitation of Liability

  • We strive to provide high-quality products and services, but we are not liable for any indirect, incidental, or consequential damages arising from the use of our products, including but not limited to health, dietary, or financial losses.
  • Our total liability, if applicable, will not exceed the amount you paid for the affected product or service.

10. Indemnification

You agree to indemnify, defend, and hold harmless Planit Protein, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of our products or website; (b) your violation of these Terms; (c) your misuse of the Planit POD appliance or Planit Protein consumables; or (d) your violation of any third-party rights.

11. Third-Party Partners & Hardware

Waring Commercial
The Planit POD fermentation appliance is exclusively manufactured and sold by Waring Commercial. Planit Protein has a commercial partnership with Waring but operates as a separate legal entity. When you purchase a Planit POD:

  • Your purchase contract is with Waring Commercial, not Planit Protein.
  • Waring's own terms of service, warranty, and return policies govern the hardware transaction.
  • Planit Protein is not liable for hardware defects, shipping issues, or appliance performance.

We encourage you to review Waring Commercial's terms and warranty documentation before purchasing the Planit POD appliance.

12. Privacy & Data Protection

14. Governing Law & Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of our products or website shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. You and Planit Protein each waive the right to a jury trial and the right to participate in a class action lawsuit or class-wide arbitration. Judgment on the arbitration award may be entered in any court of competent jurisdiction in Ventura County, California.

Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.
